TL;DR
- The Constitutional Court is continuing a contempt of court process against the Minister of Health.
- The court found that the Ministry's reported measures do not effectively guarantee compliance with orders on the sufficiency of the Unit of Payment per Capita (UPC).
- The Ministry of Health has three key obligations: correct information system deficiencies for UPC calculation, ensure UPC is sufficient to cover services, and equalize the subsidized regime UPC to 95% of the contributive regime UPC.
- The court rejected additional requests for evidence from the Ministry, stating they fall under the Ministry's and the National Health Superintendence's responsibilities.
- The contempt of court process is corrective, aimed at ensuring judicial orders are followed, but persistent non-compliance may lead to sanctions.
