TL;DR
- Nocturnal work hours in Colombia now begin at 7 p.m. instead of 9 p.m., effective December 25, 2025, as per Ley 2466 of 2025.
- The nocturnal surcharge remains at 35% of the ordinary hourly rate but now covers a longer period.
- Sectors with continuous operations like health, transport, hospitality, and security must adhere to the new surcharge and compensatory rest rules.
- Daytime work hours are now from 6 a.m. to 7 p.m., and nocturnal work is from 7 p.m. to 6 a.m.
- Exceptions to the nocturnal surcharge apply to workers in successive shifts (max 6-hour daily shifts, 36-hour weekly), public employees, and specific regulations for security and health sectors.
- The maximum weekly work jornada is reduced to 42 hours, distributable between 4 and 6 days with employer-employee agreement.
- Workers facing non-payment of nocturnal surcharges can request correction from the employer, file a complaint with the Ministry of Labor, or seek assistance from a labor inspector.
